Frequently Asked Questions
What are Legal Services?
Legal Services encompass factual research, legal research, and document preparation. Since Favor Legal staff are not attorneys, we strictly offer legal services. We highly encourage our clients to advocate for themselves, and, if a client decides it is appropriate, represent themselves pro se.
What does Pro Se mean?
For himself; in his own behalf; in person.
[This definition is provided from ‘thelawdictionary.org/pro-se/"]
Essentially, being Pro Se means you are representing yourself in court without an attorney. Someone who represents themself in court is typically called a Pro Se litigant.
Is it legal to represent myself Pro Se?
Yes! The Sixth Amendment as made applicable to the States by the Fourteenth Amendment of the U.S. constitution not only guarantees you the right to be represented by a competent attorney during criminal proceedings, it also guarantees you the right to represent yourself.
This right was later affirmed in the case of Faretta v. California, 422 U.S. 806 (1975). In this case, the Supreme Court of the United States (SCOTUS) ruled that defendants have the right to represent themselves and conduct their own defense if they choose to do so willingly and voluntarily. In this case, the state courts erred in forcing a petitioner ,against his will, to accept a state-appointed public defender and denying his request to conduct his own defense.
Can Favor Legal give me any legal advice?
No. Favor Legal does not and can not legally give our clients legal advice. Doing so would be a violation of U.S. law, and, unethical. Favor Legal strives to operate by an ethical and moral code of conduct that is in the best interests of our clients. Favor Legal recommends that all clients seek legal counsel to review any and all of it’s work product.
Do I have to have an attorney to do most legal processes?
No you do not have to have an attorney. Due process is available to all people regardless of your socio-economic standing. To say that you need an attorney for everything would essentially say that you are barred from this type of process because you are poor. That is antithetical to the values of The United States of America.
